BHS As part of the British Horse Society's work to record paths before Path Extinguishment Day, applications have been to record on the definitive map various unsurfaced routes in the county. The orange route U1 in the plan is one of these. We have examples of where the county council has 'lost' unsurfaced routes from its other records without due legal process, whereas the definitive map is much harder to alter and so provides more certainty for the public. After our application in 2010, we were delighted when the council finally made an order in 2022 to record the route. After a public inquiry in 2024, the inspector confirmed the order.

Legal History
1 Nov 1953: Kelshall 18 was recorded as CRB (Carriage Road used as a Bridleway) on the original definitive map. The rest of the route was regarded as a road and so was not recorded.
31 Dec 1977: Kelshall 18 was recorded as a byway on the special review draft map and statement. The rest of the route was not recorded. DM sheet SR-7.
2 May 2006: NERC exemption s.67(1) as recorded route shown on DM as Byway Open to All Traffic.
2 May 2006: NERC exemption s.67(2)(b) as extension route not on DM but was on LOS.
28 Jun 2010: Application to record the old road as a byway. HCC reference NH/216.
31 Jan 2019: Hertfordshire County Council directed to determine the application by the Secretary of State. (FPS/M1900/14D/16)
17 Feb 2022: The Hertfordshire County Council (Kelshall 18, 19, 21 and 22) Modification Order 2022 (confirmed 18 Dec 2024) added the route from the Byway to The Street to the definitive map and statement.
