This route starts from Cromer Heath (public road) opposite Newell Lane (public road) and heads generally southeastwards to a track to Cromer Windmill then to the B1037 (public road) then northeastwards to a junction with Cottered 26. At the time of the BHS 2022 Access Survey (Mar 22) and of the photographs below (14 Jul 22), the route was clear and unobstructed. There were no gates were across the path. There were council ‘footpath’ signs at each end, reflecting how the path is presently recorded (but note the application from 2003 for higher rights to be recorded too). There was evidence of use by equestrians.

Ardeley 49 is only recorded as a footpath, but has been riden for many years. The BHS has made an application for the route to be recorded at higher status based on the user evidence collected. Part of Ardeley 49 was already the subject of a modification order application based on historical evidence submitted by the East Herts Footpath Society.

Legal History 1839: EC460 Ardeley 49 was shown on the Ardeley tithe map as not subject to an apportionment. 2 Feb 1953: Ardeley 49 was recorded as a footpath on the original definitive map and statement. DM sheet DM1-06 (H13NW). 31 Dec 1977: Ardeley 49 was shown as a footpath on the special review draft map and statement. DM sheet SR-23 (TL32NW). 30 Jul 2003: EHFS application for part of Ardeley 49 to be recorded as a byway, with the route south to road past Cromer Windmill. HCC reference EH/287. 28 Jun 2022: Application for Ardeley 49 to be recorded as part restricted byway and part byway open to all traffic. HCC reference EH/287. 3 Feb 2025: Planning application 3/24/2245 would have affected this path, so PGBT made comments asking that sufficient space be left for the route. 4 Feb 2025: HCC prioritisation score increased from 7 to 27 because of planning application. Maintainability This route is maintainable at the public expense because it was a footpath or bridleway existing before 30 Apr 1959.
