Register of Applications

What is it?

The ‘Register of Applications’ is a register of applications made to the surveying authority (unitary or county council, depending on area), in accordance with paragraph 1 to Schedule 14 to the Wildlife and Countryside Act 1981, to modify the definitive map and statement for the area.

How does it work?

The Public Rights of Way (Register of Applications under section 53(5) of the Wildlife and Countryside Act 1981) (England) Regulations 2005 (SI 2005 No. 2461) require that the council update its register within 28 days of receiving an application.

Where can I see it?

The Register must be made available on paper at the principal office of the council and on line. For applications in Hertfordshire, the Register of Applications can be seen on the County Council’s website.

Can I take copies?

Yes, Regulation 3(5) permits copies to be taken.

“3 (5) A surveying authority shall keep the register in such manner as is suitable to enable a copy of any of the particulars contained on the register to be taken by or for any person who requests a copy in person at the principal office of the surveying authority.”

Wales

The equivalent regulations in Wales are The Public Rights of Way (Registers) (Wales) Regulations 2006 (SI 2006 No. 42).
